Fondiva Terms of Use

These terms apply to anyone who uses the Fondiva application with an account opened by their organisation. That organisation is a customer of FONDIVA SYSTEMS ("Fondiva"). The contract signed between Fondiva and your organisation defines the service provided. These terms do not change it.
Your account
- Your account is personal. Do not share your credentials.
- Your organisation's administrator opens accounts, sets each person's rights and can close an account.
- Any action taken with your credentials is deemed to be taken by you, unless proven otherwise.
- If you think someone else is using your account, tell your administrator and support@fondiva.com without delay.
What is not allowed
You agree not to:
- use the application for an organisation other than your own, rent it out or make it available to a third party;
- copy, modify, decompile or reverse engineer the application, except where the law allows it;
- bypass its security measures, or run load or penetration tests without Fondiva's written consent;
- upload unlawful content, or use the application in breach of the law or of the rights of others;
- remove Fondiva's proprietary notices and trademarks.
AI agents
The application includes artificial intelligence agents. They carry out tasks: entering information, creating a document, drafting a reply.
- The application tells you when you are interacting with an AI agent and labels the content it produces.
- A result produced by AI may contain errors. Check it before relying on it for a decision.
- Decisions belong to people. An agent action that commits your organisation towards a third party, such as sending a message, is confirmed by a person, unless a workflow published by your organisation provides for it.
- An agent can prepare and edit a draft quote: a draft does not commit your organisation to anyone. Sending and approving a quote, invoice or other document with amounts is always done by a person, and so is any payment.
- An agent can suggest a workflow. Only a user authorised by your organisation can publish it.
You agree not to:
- use AI agents for a practice prohibited by the EU Artificial Intelligence Act;
- let them make on their own a decision that produces legal effects for a person or similarly significantly affects them;
- give them data your organisation is not entitled to process;
- unless Fondiva agrees in writing, use them to recruit, evaluate or monitor employees, or to allocate tasks based on their behaviour.
Your data
The data you enter in the application belongs to your organisation. Fondiva processes it on your organisation's behalf and does not use it to train AI models. The Privacy Policy explains how Fondiva processes your account data.
Suspension
Fondiva may suspend access when the security of the application or of data requires it, for example in case of prohibited use. The suspension lasts as long as necessary. Fondiva informs your organisation.
Ownership
The application, its code and the Fondiva trademark belong to Fondiva. Your account gives you the right to use the application for your organisation's needs, as long as it remains a Fondiva customer.
Changes
Fondiva may change these terms. The new version is shown to you at your next sign-in.
